By passing the 2024 Waqf Amendment Bill, the Indian government is setting the stage for one of the most significant land takeovers in modern history. Under the pretense of reform, Prime Minister Narendra Modi’s government is attempting to seize thousands of properties donated by Muslims over centuries—from mosques and madrassas to orphanages and burial grounds. This is not just an attack on religious freedom; it is a calculated move by Hindu nationalists to undermine Muslim heritage, weaken their economic base, and consolidate power.
The government argues that the bill will curb corruption and mismanagement within waqf boards. There is truth in the claim that some waqf officials have misused their positions—collaborating with land encroachers and selling waqf properties illegally. However, the solution to corruption should be greater transparency and accountability, not a complete transfer of control to the state.
Critics rightly point out that thousands of waqf properties have already been encroached upon by businesses, individuals, and even government agencies. Yet, instead of returning these lands to the waqf boards, the government is seeking to take ownership of them. The deletion of the “waqf by user” clause—which has protected historical religious sites for decades—means that mosques, dargahs, and graveyards without formal documentation could soon be confiscated by the state. Many of these properties were donated orally or without legal records centuries ago, making it impossible to produce paperwork today.
This is not about good governance. It is about using bureaucratic loopholes to seize Muslim lands while allowing Hindu religious endowments to remain untouched.
While this bill disproportionately targets Muslims, its consequences will be felt by all Indians. History has shown that state-sponsored land seizures fuel social unrest, deepen communal divisions, and destabilize nations. If the government succeeds in taking control of Muslim endowments today, what stops it from doing the same to others tomorrow? Hindus, Sikhs, Christians, and other communities must recognize the larger threat of state overreach.
The potential fallout is clear: mass protests, legal battles, and growing resentment among Indian Muslims. Already marginalized by laws stripping Kashmir of its autonomy, a discriminatory citizenship policy, and the recent construction of a Hindu temple at the site of a demolished mosque, Muslims are seeing yet another assault on their rights. Some community leaders are warning of unrest if their religious sites are taken away. Even if violence does not erupt, the bill will deepen the sense of alienation among Indian Muslims, worsening social tensions.
India’s success as a democracy depends on fairness and inclusion. If the government continues to weaponize laws to disempower minorities, it risks weakening national unity and tarnishing India’s reputation as a secular state.
At the same time, Indian Muslims must acknowledge the internal problems within waqf boards and take action. The system has long suffered from poor management, a lack of transparency, and allegations of corruption. Reform is essential—not through government control but through greater community oversight.
Muslim leaders must push for:
- Accountability within waqf boards by ensuring financial audits and transparency.
- Inclusion of Shia, Sufi, and diverse Muslim representatives to prevent monopolization by elite interests.
- A legal and political strategy to reclaim encroached waqf properties instead of allowing them to fall into private hands.
If Indian Muslims do not take the lead in reforming their own institutions, it will give the government more justification to intervene. The responsibility lies within the community to modernize the waqf system while safeguarding its independence.
The Waqf Amendment Bill is not about reform—it is a direct attack on India’s Muslim heritage and economic base. The Modi government, emboldened by Hindu nationalist ideology, seeks to rewrite history and erode the rights of its largest religious minority. This is a dangerous step toward majoritarian rule, where one community’s faith and property are protected while another’s is systematically dismantled.
Indians of all backgrounds must stand against this injustice. If we allow the state to confiscate Muslim lands today, tomorrow, it could be someone else’s. This is a fight for fairness, democracy, and the future of India as a pluralistic society.
Muslims, too, must recognize the need for internal reform. The best defense against government encroachment is a strong, accountable, and transparent waqf system that serves the community effectively.
If India truly values its secular democracy, this bill must be opposed, reformed, or scrapped altogether. The alternative is a darker, more divided future—one where religious discrimination becomes law, and the foundations of Indian democracy are permanently weakened.
